Orphacol: l'entêtement bureaucratique continue!

Le 4 juillet 2013, l’arrêt du Tribunal de première instance de l'UE dans le cas T-301/12 a établi que l'Autorisation de Mise sur le Marché (AMM) pour le médicament français Orphacol aurait dû être accordée conformément aux deux avis positifs de l’Agence européenne des médicaments (EMA) et des Etats membres.

Pour rappel, l'orphacol est un médicament destiné à soigner une maladie orpheline et mortelle du foie (90 cas estimés en Europe). Pour pouvoir le commercialiser, le laboratoire français CTRS a introduit en octobre 2009 une demande d'AMM pour laquelle l'agence européenne ainsi que les Etats membres ont émis par deux fois un avis positif. Face au refus de la Commission européenne, le laboratoire CTRS a décidé de porter l'affaire devant le Tribunal de 1ère instance de l'UE.

Suite au jugement du Tribunal favorable au laboratoire français, la Commission européenne était censée adopter une décision d’octroi d’AMM pour s'y conformer. Cependant, il s’avère que la Commission a donné suite à la demande d’un Etat membre souhaitant discuter le projet de décision en réunion plénière.

Même s’il s’avère que cela est permis dans le cadre de la procédure de comitologie, il me semble que les réserves émises par l’Etat membre constituent de fait une remise en cause du jugement du Tribunal de 1ère instance alors que cette instance n’a pas vocation à être le forum de discussions des arrêts du Tribunal.  

Une nouvelle réunion des Etats membres est donc convoquée pour le 11 septembre. A cette occasion, l'adoption de la décision ne peut encore être repoussée pour des raisons procédurales. Dans le cas présent, les délais sont en effet importants dans la mesure où l’exclusivité commerciale est accordée pendant dix ans à tout médicament orphelin. De nouveaux retards ne feraient qu’accréditer l’idée selon laquelle le concurrent américain des laboratoires CTRS - qui cherche à commercialiser un produit similaire et dont le médicament est en voie d’autorisation par l’EMA - bénéficierait de relais d’influence à différents niveaux pour gagner du temps.

Si de nouveaux retards dans l’attribution de cette AMM devaient être avérés malgré la décision du Tribunal de l’UE, nous utiliserons au sein du Parlement européen les moyens juridiques  et politiques dont nous disposons pour faire la lumière sur ces retards à répétition et l’ « acharnement bureaucratique » que continue à connaître ce laboratoire.
